Yuga Labs and Ryder Ripps Settle Legal Dispute Over Bored Ape NFTs
Yuga Labs has reached a settlement with artist Ryder Ripps and his collaborator Jeremy Cahen, concluding a contentious legal battle that centred on the use of Bored Ape Yacht Club (BAYC) imagery and trademarks. As part of the agreement, Ripps and Cahen are permanently prohibited from using any Bored Ape-related designs, a situation that has been unfolding since 2022.
Background of the Dispute
Yuga Labs initiated its legal action against Ripps, alleging that the RR/BAYC NFT collection infringed on its trademarks by mimicking its well-known ape characters and brand. According to Yuga, this imitation blurred the lines between authentic BAYC assets and replicas, significantly benefitting the defendants financially.
Ripps defended his project by claiming it was a form of satire and should be considered as artistic expression rather than a violation of commercial rights. He also critiqued Yuga’s original collection, which the company countered as irrelevant to the matter at hand.
Legal Developments
In 2023, a district court sided with Yuga Labs, ordering the defendants to pay initial damages of US$1.5 million (approximately AU$2.18 million). This amount later escalated to nearly US$9 million (around AU$13.05 million) when including fees and penalties. This ruling highlighted the potential for confusion in the NFT marketplace, raising concerns about consumer protection.
However, this decision was not final. An appeals court subsequently overturned the ruling, asserting that the case warranted jury examination, thereby reviving the legal proceedings.
Current Settlement
The recent settlement brings an end to the dispute without necessitating a trial and establishes a permanent ban on the use of Yuga Labs’ intellectual property by Ripps and Cahen. While the specific terms of the settlement remain confidential, the resolution effectively concludes a saga that has captured significant attention within the NFT community.
This case serves as a critical example of the tensions surrounding artistic expression, satire, and intellectual property rights in the rapidly evolving digital landscape. As the NFT market continues to grow, the implications of this settlement may have lasting effects on how such disputes are handled in the future.
