Elon Musk’s OpenAI Lawsuit Fails as Jury Backs Sam Altman

A recent ruling by a California jury has seen Elon Musk’s lawsuit against OpenAI dismissed as it was filed beyond the permissible legal timeframe. Musk had accused Sam Altman and his company of deviating from their original non-profit mission to focus on commercial expansion.

The trial, held in Oakland, lasted approximately three weeks and concluded with jurors deciding in under two hours. This case included testimony from several high-profile individuals in the tech industry, such as Musk, Altman, OpenAI president Greg Brockman, and Satya Nadella, the CEO of Microsoft. Following the jury’s decision, Judge Yvonne Gonzalez Rogers affirmed her agreement with the verdict and dismissed Musk’s claims.

Musk, a co-founder of OpenAI in 2015 who left the organisation in 2018, filed the lawsuit in 2024. He argued that Altman and Brockman had breached OpenAI’s founding principles by pursuing profit-driven activities instead of adhering to the non-profit ethos. In his claims, Musk cited a financial contribution of approximately US$38 million (AU$53.2 million) made under the impression that the organisation would prioritise humanitarian benefits.

OpenAI, in response to the lawsuit, contested Musk’s assertions, claiming he was aware of the potential shift towards a profit-making structure. The defence emphasised that this restructuring was essential to compete within the escalating costs of the artificial intelligence industry, particularly against rivals like Google DeepMind.

Additionally, Musk’s lawsuit implicated Microsoft, alleging the tech giant had aided OpenAI in its journey toward commercialisation following substantial investments in the organisation. This aspect of the lawsuit was also dismissed by the jury.

Following the judgement, Musk expressed his dissatisfaction on X, indicating his plans to appeal the decision. OpenAI representatives celebrated the ruling, characterising Musk’s lawsuit as an effort to undermine a commercial competitor rather than a genuine dispute regarding the organisation’s founding mission.
