Fresh tariff setback could provide businesses with a two-month reprieve before new duties come into effect.

A recent ruling by the Court of International Trade has dealt a significant blow to President Trump’s tariff strategies, offering some businesses a potential respite from the imposition of tariffs in the short term. In a split decision on Thursday, the court has effectively halted the president’s 10% global tariffs, at least until higher courts possibly intervene.

The ruling, which followed a 2-to-1 vote, found that the legal basis for the tariffs—specifically referencing section 122 of the Trade Act of 1974—did not meet the necessary standards to justify such import charges. Consequently, the court has placed a permanent injunction in favour of the plaintiffs, who are importers, signalling a shift in how businesses may approach importation in the coming months. For many importers, who typically face lengthy timelines associated with import decisions and tariff payments, the ruling could prompt a reevaluation of their trading strategies.

Earlier this year, the Supreme Court declared invalid Trump’s “Liberation Day” tariffs, which were enacted under emergency economic powers. Although he swiftly introduced alternative tariffs, the business community has shown remarkable adaptability, often increasing imports to avoid tariff costs. This trend was particularly evident during the four months following Trump’s election, where import levels soared, leading to a record trade deficit in March 2025.

However, while some tariffs may be on pause, others remain unaffected by the recent ruling. Tariffs imposed on China and various automobile imports are expected to continue, as they are enforced under separate legal provisions not challenged in this latest court decision. This ongoing uncertainty comes at a critical point, as President Trump is set to make a high-profile visit to China next week, where further tariffs may be on the agenda.

The outcome of this ruling may provide a temporary reprieve for importers, but the potential for an appeal by the Trump administration looms large, leaving the final impact of this decision yet to unfold. As the business landscape evolves amidst these fluctuating tariff dynamics, companies will need to remain agile to navigate the complexities introduced by current trade policies.
