Judge Throws Out xAI’s Trade Secret Lawsuit Against OpenAI

A recent ruling by a US federal judge has resulted in a significant legal setback for Elon Musk’s xAI, as a lawsuit alleging that OpenAI unlawfully obtained trade secrets related to the Grok chatbot has been dismissed. Judge Rita Lin’s decision, made on 15 June, determined that xAI failed to provide adequate evidence that OpenAI had encouraged a former engineer, Xuechen Li, to disclose confidential information during his recruitment process.

The crux of the dispute centred around a presentation given by Li during his discussions with OpenAI. xAI claimed that OpenAI had deliberately targeted Li due to his involvement with critical aspects of Grok 4, particularly in reinforcement learning and post-training processes, with the intent of gaining access to protected information.

### Recruitment Discussions Found to Be Standard Practice

Judge Lin’s ruling indicated that xAI’s assertions were not enough to confirm that OpenAI had engaged in any misconduct regarding the solicitation of trade secrets. She clarified that it is standard hiring practice to discuss a candidate’s previous work, and such discussions do not inherently suggest the misuse of confidential information. The court also stated that xAI did not prove that OpenAI was aware or should have been aware that any sensitive information might have been revealed.

Moreover, the judge pointed out that xAI’s complaint lacked clarity regarding what specific details were allegedly disclosed and the extent of information included in supportive documents. Ultimately, the lawsuit was dismissed with prejudice, meaning xAI cannot refile similar claims in the future, following a previous dismissal of an earlier version of the case in February.

This decision adds to Musk’s growing list of legal challenges, particularly following a federal jury’s rejection of his US$150 billion (AU$213 billion) lawsuit against OpenAI, CEO Sam Altman, and Greg Brockman in May.
